Terms of Service.

• We provide a subscription service for server-side tracking, event routing, identity handling, and operational tooling.
• You keep ownership of your event data; we process it on your behalf to run the service.
• You are responsible for lawful collection, credentials security, and accurate account information.
• Subscriptions auto-renew, annual plans have a 30-day refund window, and soft caps move usage into the next pricing tier.
• Liability is capped at the fees paid in the prior 12 months, and disputes are governed by German law with Berlin courts.

TrackLayer provides hosted infrastructure for event ingestion, deduplication, identity resolution, forwarding to downstream marketing and analytics platforms, dashboards, APIs, and related support. We may update features to improve security, compatibility, and reliability.

You must keep credentials confidential, maintain accurate account and billing information, and use one organisation workspace per legal entity unless we agree otherwise in writing. You are responsible for activity that occurs through your account.

You retain ownership of your event data and related content. You appoint TrackLayer as processor to host, transform, store, and transmit that data so the service can function. For end-user events, you remain the data controller and are responsible for notices, consent, and lawful basis.

You may not use the service to:

• send illegal event payloads or data obtained in violation of applicable law;
• process personal data of EU data subjects without a lawful basis;
• generate mass fraudulent traffic, fake conversions, or abusive replay traffic;
• probe, disrupt, or circumvent service security controls.

Paid plans are billed in advance on a subscription basis and renew automatically until cancelled. Annual plans may be refunded within 30 days of the initial purchase. Usage caps are soft caps: if sustained usage exceeds the current allowance, the account will be moved to the next pricing tier for the next billing cycle.

We target 99.5% monthly uptime for the production service. That target is an operational objective, not a warranty. If unscheduled downtime exceeds one continuous hour in a billing month, you may request service credits equal to 5% of that month’s fee for each additional hour of unscheduled downtime, up to 50% of the monthly fee.

You may cancel at any time and the cancellation takes effect at the end of the current billing term unless required otherwise by law. We may suspend or terminate access for abuse or non-payment, and where practical we will provide 30 days’ notice before termination.

To the maximum extent permitted by law, each party’s total aggregate liability under these terms is capped at the fees paid by you to TrackLayer in the 12 months preceding the event giving rise to the claim. Neither party is liable for indirect, incidental, special, or consequential damages, including lost profits or lost goodwill.

These terms are governed by the laws of Germany, without regard to conflict-of-law principles. Courts in Berlin, Germany have exclusive jurisdiction over disputes arising from or relating to these terms.

We may update these terms from time to time. We will email merchants about material changes, and continued use of the service after the effective date constitutes acceptance of the revised terms.
